过户流程简介

  1. 您签署住宅物业买卖合同 (Residential Purchase Contract) 并取消合同所附条件(签署waiver)后,合同即具有了约束性。 律师一般在此时介入,开始办理合同履行及物业过户手续。(请注意,在律师提供物业过户服务的过程中,因为买卖合同已经签署并生效,因此律师仅负责合同的履行,无权对合同内容作出改变。若遇到一方违约、需要法律服务的情形,律师会将合同纠纷作为另一个案件单独受理,并另行收费。您可以选择继续由过户律师办理,也可以聘请其他律师办理。)
  2. 在收到合同后,我们会根据交房日及与对方律师沟通的情况合理安排过户所需各项文件,并与您预约签字时间。签字时间通常设在交房日前的1-3个工作日,届时您需要签署土地局要求的物业过户文件。如果远程签字,需要邮寄文件的,我们会安排提前签字,并加收远程签字费。
  3. 我们会在预约的签字日前发邮件给您,告知您需要带来的资料。
  4. 一般情况下,您的购房款差额部分需在签字日支付给律师。购房款、费用调整项及律师费等,需以Bank Draft形式开给本所信托账户,具体金额和抬头我们会写在邮件中。
  5. 在交房日当天,我们会将收到的您交来的购房款,交予卖家律师。卖家律师会在收到款项后通知卖家将物业钥匙交予您。交房日当天您不需到律师事务所来。
  6. 交房后,我们会将签署完毕的过户文件提交土地局办理过户手续。目前的办理时间为2-3个月左右。
  7. 收到过户完成的新产证后,我们会在合理时间内将产证及相关文件上传到我们的client portal,或者发邮件给您。过户手续至此基本完成。

Transfer Process Overview

  • Once you sign the Residential Sale and Purchase Contract and waive any attached conditions, the contract becomes firm and binding. Typically, at closing stage, the lawyer gets involved to initiate the contract fulfillment and property transfer procedures. Please note that during the property transfer process, as the contract has been signed and is effective, the lawyer is only responsible for contract fulfillment and has no authority to alter the contract terms. If there is a breach of contract or a need for legal services, the lawyer will handle the contract dispute as a separate case and charge additional fees. You can choose to continue with the transfer lawyer or hire another lawyer for this matter.

  • Upon receiving the contract, we will reasonably arrange the necessary documents for the transfer based on the closing date. We will schedule a signing appointment with you, usually 1-3 working days before the handover date. You will need to sign the property transfer documents required by the Land Title Office. If remote signing and document mailing are necessary, the signing appointment will be set even earlier to allow more days for document delivery, and we will charge a remote signing fee.

  • We will email you in advance of the signing date, informing you of the documents and cash shortfall you need to bring.

  • In general, the outstanding balance of your property purchase price needs to be paid to the lawyer on the signing date. The purchase price, adjustments, and lawyer fees must be paid to our trust account in the form of a Bank Draft. We will specify the exact amount and payee in the email.

  • On closing day, we will pass the cash to close to the seller's lawyer. After receiving the payment, the seller's lawyer will inform the seller's realtor to hand over the property keys to you. You do not need to visit the law firm on closing day.

  • After closing, we will submit the signed transfer documents to the Land Title Office for registration. The current processing time is approximately 2-3 months.

  • Upon receiving the new land title certificate under your name, we will upload the certificate and related documents to our client portal or email them to you within a reasonable time frame. The transfer process is essentially completed at this stage.

Overview of Real Estate Transfer Process for Sale:

  • Confirmation of Information: Confirm various details with the lawyer, such as loan arrangements and signing schedules.

  • Signing Transfer Documents: Meet with the lawyer to sign the transfer documents (usually scheduled 3-5 days before the handover).

  • Cancellation of Property Tax Installment Plan (TIPP): If you are enrolled in a property tax installment payment plan, please remember to cancel it. If the cancellation is initiated before the 22nd of the month, no deductions will occur from the following month. After canceling the plan, please inform us.

  • Closing Day: On the day of closing, after receiving the purchase amount, the lawyer will inform your real estate agent to hand over the keys to the buyer.

  • Payment Allocation: The lawyer will deduct mortgage repayments, agent fees, legal fees, and other applicable expenses from the sale proceeds and then transfer the remaining amount to you.
